ROXAS City — The city prosecutor’s office has dismissed the four counts of libel filed by former Pilar mayor Gideon “Ike” Patricio against dyVR RMN radio block-timer Salvador “Jun” Capulot Jr.
In a seven-page resolution, Assistant City Prosecutor Eduardo Delfin said the act being complained is within the protective mantle of qualified privileged communication and is, therefore, not actionable.
Earlier, Capulot and Ely Abarra, dyVR RMN Roxas station manager, were slapped with four counts of libel and damage claim of P2 million each.
However, Patricio dropped Abarra’s case after a negotiation.
In his affidavits, Patricio said Capulot, in his block time program Mr. Bistado aired over dyVR RMN Roxas, portrayed the former as “crocodile” called “Lolong” and accused him of theft of antique items from the municipal hall, which were allegedly transferred to his house.
He also said Capulot accused him of having goons and of being a protector of illegal fishing in Pilar.
Patricio, however, strongly denied those accusations.
